Terms and Conditions
  1. DarlingRange.com.au provides this service and for the purposes of these Terms and Conditions, will be stated as "The Company".
  2. Customers who engage "The Company" in setting up a site - "The Service" and having it hosted by "The Company" will be referred to as "The Customer". These Terms and Conditions will be referred to as "The Terms". Upon registering for "The Service", "The Customer" is agreeing to "The Terms". "The Customer" may not use "The Service" if "The Customer" does not accept "The Terms".
  3. By accepting "The Terms" "The Customer" is acknowledging you understand and agree that "The Company" will treat your use of "The Service" as acceptance of "The Terms" from that point onwards.
  4. You - "The Customer" may not use "The Service" and may not accept "The Terms" if you are not of legal age to form a binding contract with "The Company" or you are a person barred from receiving "The Service" under the laws of the country you reside in.
  5. "The Company" reserve the right to make changes to "The Service" at any time. Where changes conflict specifics set out in "The Terms" "The Company" will submit notice to "The Customer" of termination of this agreement and will supply a new agreement to "The Customer" for approval. As stated "The Service" is provided on a month by month basis only.
  6. "The Company" offers free to "The Customer" "The Service", limited to new non-business customers only. There is no maximum duration of "The Service", but it is provided month by month.
  7. "The Company" will be placing advertisements with "The Service".
  8. "The Company" reserves the right to refuse content at its own discretion. Although "The Company" do not accept liability for the content, this resides with "The Customer".
  9. "The Company" reserves the right to refuse applications at its own discretion, without the necessity to offer explanations.
  10. "The Company" will make every effort to ensure the continuous running of "The Service", but do not accept any liability on the part of "The Customer". There will be no compensation for any lose of "The Service". "The Customer" on "The Service" acknowledge there is no entitlement, in terms of service or compensation for "The Service".
  11. All ownership rights, in terms of computer hardware, network, bandwidth, etc remain the property of the "The Company". Any changes to content will be made by "The Company". At no point will access to granted to "The Customer". Changes are to be submitted to "The Company".
  12. Any content submitted to "The Company", by "The Customer" will only ever be used as directed by "The Customer" and will be destroyed upon request or after termination of "The Service".
  13. By "The Company" providing "The Service", it is in no way accepting responsibility for "The Customer" financial concerns. "The Service" is provided "AS IS".
  14. "The Service" to "The Customer" will be limited to a maximum of 3 static web pages - without logic, unless a separate agreement is made by "The Company". Any images will need to be supplied by "The Customer". "The Company" withholds the right to reject requests, where the content is overly complex or excessively time constrained, according to "The Company" sole discretion.
  15. Whilst every effort will be made by "The Company" to respond to enquiries about "The Service", "The Company" does not accept any responsibility, where "The Customer" incurs any financial lose - in connection to "The Service". "The Customer" on "The Service" acknowledge there is no entitlement, in terms of service or compensation for "The Service".
  16. Termination of "The Service" and this agreement can be initiated by either "The Company" or "The Customer" without notice or lose. "The Customer" acknowledges that termination of "The Service" means their site will be removed and no longer accessible.
  17. "The Customer" acknowledges that although "The Company" may enter into this agreement on this occasion, "The Company" may choose not to enter in future agreements and in no way is bound to accept future agreements.
  18. A copy of "The Terms" should be printed off and saved for your records.
